McDan Aviation Limited has accused the Ghana Airports Company Limited (GACL) of violating a court injunction and breaching contractual agreements following what it describes as a midnight raid on its facility at Terminal 1 of Kotoka International Airport.
In a statement issued on March 12, the company alleged that officials of the state-owned airport operator forcibly entered its Fixed Base Operation (FBO) terminal around 1:00 a.m. on March 11 and removed equipment and property belonging to the company.
According to McDan Aviation, the action occurred shortly after GACL had been served with a motion for an interlocutory injunction on March 10, making the operation a deliberate disregard for the judicial process.
The company said it had invested millions of dollars to establish Ghana’s first private FBO terminal at Terminal 1 under a licence agreement signed with GACL in August 2022. It also maintained that it had consistently met its rent obligations over the years, despite a brief delay in payment which it said had since been fully settled.
McDan Aviation further argued that the licence agreement requires GACL to provide a 90-day eviction notice before any removal action can be taken, a provision it claims the airport operator failed to respect.
Describing the incident as both a breach of contract and contempt for the rule of law, the company said it is pursuing legal action to challenge what it called the unlawful termination of its operations.
McDan Aviation also reaffirmed its commitment to Ghana’s aviation sector and called on stakeholders to uphold the rule of law and support indigenous businesses.
