The ECOWAS Community Court of Justice has dismissed all seven claims brought by former Chief Justice Gertrude Torkornoo against the Republic of Ghana, according to Deputy Attorney-General and Minister for Justice Justice Srem-Sai.

The case arose from Justice Torkornoo’s challenge to her suspension and removal from office, which she argued violated her rights under the African Charter on Human and Peoples’ Rights. However, the regional court found that Ghana had not breached any of the rights cited in her application.

As a result, the court also rejected her request for US$10 million in damages, stating that there was no basis for compensation since no rights violation had been established. According to Justice Srem-Sai, the court ruled that it would make no decision on reparations after concluding that Ghana had not infringed the applicant’s rights.

The ruling effectively ends the claims pursued by Justice Torkornoo before the ECOWAS Court. Following the decision, Justice Srem-Sai praised the state attorneys and legal team that represented Ghana, commending their extensive research and preparation, which he said contributed significantly to the successful defence of the case.
